Contracts Manager
We are looking for a strong pre-contract negotiator who is familiar with complex subcontractors and who is willing to roll up their sleeves when it comes to reviewing these.
You should have experience in reviewing contractual terms and negotiating on these.
This role will join our Sales & Service department (across all BU’s) in a Commercial & Contracts Manager role, working on a hybrid basis, close to one of our office locations, in Kent or the Midlands.
Coupled with this, your strong understanding of Commercial processes, will make you the ideal candidate.
In this exciting role, you will be responsible for the commercial input and review of contracts supporting the BU’s sales functions, working closely with internal and external sales teams. Reporting into the Managing Director UK&I, you will be safeguarding Swegon’s business interests and responsible for ensuring a consistent approach across all BU’S regarding risk management, pre-contract reviews, customer frameworks and rebate agreements.
What you can expect as the Contracts Manager:
Commercial Strategy:
- Develop and implement comprehensive commercial strategies aligned with business objectives, maximising profitability, and minimising risk.
- Governance and control of customer Rebate Agreements across various BU’s working closely with the relevant Sales Managers and BU Directors.
- Work with S&F and RU export sales teams to ensure the company is protected from cross border embargos and compliancy constraints.
- Taking a lead role in resolving commercial issues that may arise.
Contract Management:
- Contractual review, negotiation and finalisation of Customer contract terms and conditions also in the Tendering phase, including identification and removal of non-market standard or otherwise onerous or unacceptable obligations or liabilities (including collateral Warranties and Performance Bonds) and ensuring Swegon’s contractual rights are included.
- Manage the review and drafting of various contracts, including NDAs, SLAs, service agreements, purchase orders and Sub-contractor Orders.
- Ensure accurate and timely contract execution, ensuring compliance with all terms and conditions.
- Oversee contract administration, including change order management, performance monitoring, and reporting.
- Identify and manage contract risks, implementing mitigation strategies to minimize potential losses.
- Resolve contract disputes effectively and efficiently, protecting the company's interests.
- Where appropriate, assist in the selection and appointment of subcontractors to ensure appropriate terms and conditions of appointment.
Other Responsibilities:
- Ensuring conditions for prompt payment are managed related to queries & disputes around monthly applications.
- Develop and implement effective contract management processes and systems.
- Stay up to date on relevant legal and commercial regulations, ensuring compliance with industry best practices.
- Provide expert commercial advice, guidance, and training to internal stakeholders.
- Prepare comprehensive reports and presentations on commercial activities and contract performance.
We are looking for someone with:
Essential:
- Experience of management and leadership
- Customer service and commercial contracts experience
- Training/coaching
- Previous experience of dealing with engineering main contractors, architects, consultants and local authorities - ideally within the Building Services sector
Desirable:
- Understanding of the Building Envelope, HVAC and Building Services industries & contracting
- Knowledge & experience of having product specified by engineering Architects and Consultants
- Experience of manufacturing or similar environment
Qualifications and Education
Essential:
- Degree Qualified ideally in a business-related field
- Computer literacy
- Customer Service experience
- Leadership experience
Desirable:
- Proven record of team management/development
- Product experience and training for Building Envelope, HVAC and/or associated equipment
